The breath test is the most common type of alcohol test given in Miami dui cases. Dui attorneys need to track down the last time the machine was calibrated if there are any potential recalls on that model of machine.
The machine is deemed to be less reliable than the blood draw, so if the accused submits to a BAC Breath Test they should immediately question the results and ask for a blood draw test. The two results will differ and an interpolation can be done by a medical expert witness to show in many cases that the BAC was continuing to rise and that at the point of the officer pulling the defendant over the person was below the legal limit. |
